Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Med Valley AI (“Med Valley,” the “Service”), operated by Sim Tec MD Inc.(“we,” “us,” “our”), a corporation based in Alberta, Canada. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use Med Valley — and important medical disclaimer

Med Valley is an educational training tool for medical students, trainees, and clinicians. You must be at least the age of majority in your jurisdiction (and no younger than 18) to use it.

Med Valley is for education and training only. It is not medical advice and must not be used for real patient care. Cases, simulated patients, investigations, and the AI-generated feedback and grading are produced by artificial intelligence, are hypothetical, and may be inaccurate, incomplete, or clinically wrong. The Service does not create a clinician–patient relationship, does not provide diagnosis or treatment, and is not a substitute for formal medical education, licensed clinical judgment, supervision, or authoritative references. You are solely responsible for verifying any information against trusted sources and for all clinical decisions you make in practice.

2. Your account

You must provide accurate registration information and keep your login credentials secure. You are responsible for activity under your account. Accounts are for a single individual — do not share them. Notify us at support@info.medvalley.ai if you suspect unauthorized use.

3. Free trial, subscriptions, and billing

  • Free trial. New accounts receive a 15-day free trial with no credit card required. When the trial ends, continued access requires a paid subscription.
  • Pricing. The subscription is USD $17.00 per month, or USD $81.60 billed once every 6 months (a 20% saving). Prices are in U.S. dollars and exclusive of any applicable taxes.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly, or every 6 months) at the then-current price, using your payment method on file, until you cancel.
  • Cancellation. You may cancel anytime through the billing/customer portal in your account. Cancellation stops future renewals; you keep access until the end of the period you have already paid for.
  • No refunds. Payments are non-refundable, and we do not provide refunds or credits for partial periods, except where required by law. The free trial is provided so you can evaluate the Service before paying.
  • Payment processing. Payments are processed by Stripe. We do not store your full card details. Price or plan changes will be communicated in advance and apply to subsequent renewals.

4. Acceptable use

You agree not to:

  • use the Service for actual clinical decision-making or patient care;
  • attempt to disrupt, overload, or circumvent rate limits, security, or access controls, or probe the Service for vulnerabilities without authorization;
  • scrape, copy, resell, or redistribute case content, or use it to train or build a competing product;
  • reverse engineer, decompile, or attempt to extract source code, prompts, or models except as permitted by law;
  • upload unlawful content, real patient-identifiable information, or content that infringes others’ rights; or
  • use the Service in violation of any applicable law or regulation.

5. Content and intellectual property

The Service, including its software, generated cases, feedback, graphs, and design, is owned by Sim Tec MD Inc. or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal educational purposes while your account is active. Text and responses you submit remain yours; you grant us a license to process them to operate, personalize, and improve the Service (see the Privacy Policy).

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, reliability, or clinical correctness of any content or AI output. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of liability

To the maximum extent permitted by law, Sim Tec MD Inc. and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on Service content or AI output, including any clinical, academic, financial, or health-related outcome. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless Sim Tec MD Inc. from claims, damages, and expenses arising out of your misuse of the Service, your violation of these Terms, or your reliance on Service content for any actual clinical or professional decision.

9. Suspension and termination

We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. You may stop using the Service and cancel your subscription at any time. On termination, your right to use the Service ends; sections that by their nature should survive (including disclaimers, liability limits, and governing law) will survive.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Alberta, Canada for any dispute, subject to any mandatory consumer-protection rights in your place of residence.
